PURPOSE:

To permit the construction of pool equipment, air conditioning unit and a garden shed as follows:

PROPOSAL:

1. To permit a minimum interior side yard setback of 0.3 metres to pool equipment. 2. To permit a minimum interior side yard setback of 0.3 metres to an A/C unit. 3. To permit an accessory structure (garden shed) with a maximum height of 3.0 metres.

BY-LAW REQUIREMENT:

1. A minimum interior side yard setback of 1.2 metres is required. 2. A minimum interior side yard setback of 1.2 metres is required. 3. A maximum height of 2.5 metres is permitted.

A sketch is attached illustrating the request. This application will be heard by the Committee of Adjustment on the date and time shown below.

Official Plan:

The subject lands are designated “Low-Rise Residential” by City of Vaughan Official Plan 2010 (VOP 2010). The proposal conforms to the policies of the Official Plan.

Comments:

Planning Department Staff conducted a site visit with photo documentation on August 12, 2015. The subject lands are developed with a one-storey single detached dwelling with an existing deck and garden shed in the rear yard. The Development Engineering and Infrastructure Planning Services Department has indicated no objection to the location of the pool equipment and existing A/C unit as it will not adversely affect the existing drainage pattern. Accordingly, the Planning Department has no objection to Variances #1 and #2. The Owner is proposing to replace the existing garden shed with a new garden shed in the same location. The Planning Department also has no objection to the increased height for the new garden shed in the rear yard. The accessory structure will not physically or visually impact any abutting properties as it is partially shielded by existing vegetation (trees and shrubs) along the rear lot line. The accessory structure also complies with all other setback requirements of Zoning By-law 1-88. Accordingly, the Planning Department supports Variance #3. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Condition(s):

None.

Recommendation:

The Planning Department supports Minor Variance Application A250/15.

COMMENTS:

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
